A fed appeals court on Wed reversed an order requiring TX to move a floating barrier on the Rio Grande that drew backlash from MX -the latest in legal battles b/w: Biden admin & Gov Abbott. In Dec, a divided panel of the 5th Cir. had sided with a fed district judge in TX: buoys must be moved. On Wed, the court vacated the panel’s 2-1 ruling after a majority of its 17 active judges voted to rehear the case.

From what it sounds like, the crux of Alina Habba's argument in the moments before the trial break is that E. Jean Carroll, an 80-year-old woman and extraordinary writer living in New York, should have kept a meticulous and detailed record of the innumerable death threats she's received over the last few years as a response to Donald Trump's ongoing harassment against her.

For the strangest reason, I don't think that's going to fly before the jury.
