Whoever is feeding Biden this sophistry needs to be fired. The President doesn't ask courts for permission in advance and the courts can't even grant it, it'd be an advisory opinion.

If the GOP House and GOP SCOTUS want to wreck the country, it's Biden's job to try to stop them.

@maxkennerly I'd still prefer he gets the advisory opinion to consider instead of taking my governor's route of just boldly declaring things and letting the courts clean it up later.

@LouisIngenthron Biden can't get an advisory opinion from a federal court. It's unconstitutional and meaningless. en.wikipedia.org/wiki/Advisory

@maxkennerly Okay, fair; I only said that specifically because you used the term first.

But the point stands that his admin should take their time to do their homework before barreling forward.

Congress holds the purse and they've already conceded too much power to the executive. Do we really need more power in the hands of a single individual?

@LouisIngenthron @maxkennerly If taking the 14th route means debt limit laws are essentially meaningless it still leaves the power with Congress when they decide to spend money. The difference would be that it will in fact have to be paid for as-is, without threatening a default.

@catharineburki Yes, setting a new precedent that defies separation of powers with undue consideration is absolutely "barreling forward".

@catharineburki Yes. Democrats should have just all gotten on the "Republicans are about to screw you" wagon and then let the Republicans openly screw up so their voters have a better idea of how the reps they elected are choosing to wield their power.
Instead, they're just playing right into the stupid game Republicans created.
