It really annoys me when certain supposed #law experts misrepresent the First Amendment and #FreeSpeech. Not matter how obscene and abhorrent, #Trump’s speech doesn’t meet the Brandenberg test of inciting imminent lawless action.

Or perhaps Mr. Tribe is talking about the true threat standard, which again, I do not believe Trump’s comments fall under. Look, I’m not condoning Trump’s comments at all but I’m having a really tough time believing that Trump’s words—no matter how vile—are unprotected under the First Amendment. Though I definitely think the judge in the case should sanction him

@SarahOestreich Telling his crazed minions, who have hurt people before, that a military officer should be executed seems to stretch free speech.

Unless Trump directs them to cause imminent lawless action, he's not responsible for what they do.

This is a good thing. If the standard wasn't so high, Trump's DOJ would have been able to use it to jail dems who supported the BLM protests.
