@uspolitics Quite a lot of criminals across America are on the edges of their seats to see how this goes. If he wins it means that people can order illegal activities, thefts, even assassinations and just tell the police "I was just exercising my free speech" as long as they don't do it themselves.

In this case, it's really just a question of whether the prosecution can meet the high legal standard defined by that precedent.

"Lyrissa Lidsky, a scholar of the law, stated that 'Brandenburg's sanguine attitude toward the prospect of violence rests on an assumption about the audiences of radical speech. Brandenburg assumes that most citizens ... simply are not susceptible to impassioned calls to violent action by radical speakers.'"
As we know, many people are indeed susceptible
