Putting this r/law screencap in context:

1. In the US, CSAM content is strict liability and could land you in prison (either for viewing or creating).
2. Elon reinstated someone posting CSAM content (and therefore whose tweets are more likely to hit your feed).
3. Twitter's timeline is algorithmic, so you don't control what's shown on your feed.

Ergo, there is no way to guarantee avoiding CSAM on Twitter/X except by deleting your account.

@deirdresm

So for humans it is illegal to create or share CSAM, So what is the legal position if an AI or computer algorithm does this? Perhaps in this situation the liability should fall to the person or persons who created the algorithm or the person or persons who allowed this to be created.

We can't create a situation where this material is shared and no one is accountable.

I am not a Layer so asking generally as it seems there are loopholes that WILL be exploited.

@zleap @deirdresm

I don't know exact legalities, but elsewhere in the World there is a consensus that those writing computer software try to *reduce* harm, and not doing so could be civil or criminal negligence (depending on jurisdiction).

For example, many German sports cars can go way faster than 250 km/h (155 mph), and some autobahns have no max speed limit but many of performance cars have a 250 km/h limiter programmed into the ECU (which has been the case as early as 1987!)

@zleap @deirdresm

Volvo is going further introducing a 180 km/h (112 mph) limiter to newer cars. These trends aren't even driven directly by laws, but by a voluntary consensus to reduce road traffic collision casualties and pollution.

In contrast, what Musk is doing is removing safety infrastructure from a system...

I can see before too long Musk falling foul of some of the new laws that are coming up and being summoned before a judge

If he refuses the trail may go ahead anyway, prosecution evidence presented to the court, if no defence is offered then he may be found guilty and sentenced, I just wonder what will happen if he gets added to the UK sex offenders register.

or what could happen is an investigation will lead to individual developers who will be hauled in to court.

Going back to WWII holocaust concentration camps the drive to bring those responsible before the courts went after EVERYONE and didn't allow for that many (if any) excuses for their actions.

The same perhaps needs to happen here, you worked at Twitter / X helped to develop the very algorithms that allowed CSAM to spread, you could have quit, decided not to, and therefore YOU are partly responsible.
